Client Privacy Policy

Your privacy is important to us. The websites, mobile and custom applications, widgets, and scripts, together with any services, software, or materials provided by Givz Inc. (“Givz”) through or in connection with any of the foregoing, are collectively referred to as the “Service.” The Service may be provided via Shopify, in the form of the Givz Donation Driven Marketing Shopify App (“Givz Shopify App”), or another third-party platform. This Privacy Policy addresses our collection, use, and disclosure of information during your use of the Service, including when you install or use the Givz Shopify App in connection with your Shopify-supported store. UNLESS OTHERWISE DEFINED IN THIS PRIVACY POLICY, TERMS USED IN THIS PRIVACY POLICY HAVE THE SAME MEANINGS AS IN THE GIVZ TERMS OF SERVICE.

References to “we,” “us,” and “our” refer to Givz Inc., provider of the Service. References to “you” and “your” refer to a Givz business client using the Service, together with their employees and other representatives  who may access the Service on behalf of those business clients. If you are entering into this agreement on behalf of a company or other entity, you represent that you have the authority to, and do hereby, bind such entity to this agreement. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and neither you nor such entity may use the Service.

We may amend this Privacy Policy at any time by posting the modified Privacy Policy. The modifications will be effective upon such posting (unless a later date is specified in the posting, in which case that date will be the effective date of the modifications). You agree to review this Privacy Policy periodically so that you are aware of any modifications. Your continued use of the Service after such modifications constitutes your acknowledgment of, and agreement to be bound by, the amended Privacy Policy.

Applicability of this Privacy Policy: This Privacy Policy applies only to Givz business clients’ use of the Service. This Privacy Policy does not apply to use of the Service by individual Users, including individuals who visit the stores of our business clients as well as individuals who make donations to charities directly through our Service, and individuals who visit our website. These individuals should refer to our separate User Privacy Policy .

THE SERVICE IS OFFERED FROM THE UNITED STATES OF AMERICA AND IS NOT CURRENTLY OFFERED TO PERSONS IN THE EUROPEAN UNION OR ITS MEMBER STATES (THE “EU”). IF YOU ARE RESIDING IN THE EU, YOU MAY NOT USE THE SERVICE.

1. Personal Information the Service (including the Givz Shopify App) Collects

1.1 Information We Collect From You.  When you install the Givz Shopify App, we are automatically able to access certain types of information from your Shopify account using Shopify’s API: Information about you and others who may access the Givz Shopify App on behalf of your store, including your and their names, postal addresses, email addresses, phone numbers, and billing information.  We also collect certain information from you in order to manage your account with Givz, including credit card numbers and associated billing information.  This information is “Personal Information” because it can be used to identify you as well as the employees and other representatives who may access the Givz Shopify App on behalf of your store.  

We may also collect technical information about your use of the Service, including your IP address, web browser details, time zone, and other location-based data, some or all of which may be Personal Information. We collect Personal Information directly from the relevant individual, through your Shopify account, or using the following technologies: “Log files” track actions occurring on the Service, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

1.2 Information We Collect From Individuals Who Visit Your Stores.  We also collect information about individuals who visit your stores, our collection and use of which are governed by the Givz User Privacy Policy. This information includes (a) Personal Information (name, phone number, email address, home and business postal addresses, photos and date of birth), (b) non-identifying Information (zip code, gender, age, and individual preferences); (c) usage data (information sent automatically by a User’s browser when visiting your stores and/or our Service, such as browser type, operating system, referring/exit pages, pages visited on the Service, time spent on those pages or interacting with certain portions of the Service, information searched for on the Service, access times and dates, and geolocation data); and (d) transaction data (information relating to transactions with individuals who visit your stores and/or our Service, including purchase information, dates of purchase and purchase history). Each of these categories of information, and our collection and use thereof, is further described in the Givz User Privacy Policy.

2. How Do We Use Personal Information We Collect?

We use the Personal Information we collect from you and your customers in order to provide the Service and to operate the Givz Shopify App. Additionally, we use this Personal Information in order to: Communicate with you; optimize or improve the Givz Shopify App; and provide you with information or advertising relating to our Service.

  • To register your account in our system
  • To personalize your experience using our Service
  • To send you updates about our Service, e.g. best practices, ideas for upcoming campaigns, new product or feature releases
  • To collect usage data, i.e. to understand how you use our Service

3. Sharing the Personal Information We Collect

We share the Personal Information we collect with third parties in order to provide our Service.  Currently, these third parties are the following:

  • Web hosting provider
  • Database hosting provider
  • Payment processing, invoicing, billing support
  • Donor Advised Fund Partners such as PayPal Giving Fund (PPGF)
  • Analytics provider (Google Analytics, HubSpot)
  • Email Service Provider – to send emails related to use of the service (e.g. Welcome email, best practices) and for email marketing

Third parties with whom we share the Personal Information we collect may change from time to time, as business circumstances.  In such events, we will update this section as appropriate in accordance with our amendment practices.  

In addition to the above, we may share or disclose the Personal Information we collect to comply with applicable laws and regulations, to respond to a lawful request for information we receive, or to otherwise protect our rights.

4. Data Retention

We will retain the Personal Information we collect for only as long as is necessary to provide the Service or as required by applicable law. We will, consistent with your directions, return, delete, destroy or make permanently unreadable all Personal Information that we collect, including all originals and copies of such Personal Information in any medium, and any materials derived from or incorporating such Personal Information, within 30 days following the termination or expiration of your Service with us, except to the extent that Givz is required by law to retain some or all of the Personal Information, and except to the extent the Personal Information is archived on back-up systems, in either case so long as we securely protects and anonymizes such Personal Information from any further processing and eventually delete or makes permanently unreadable in accordance with our retention and deletion policies.
